III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the operator during <br /> the field inspection but Bill Bear represented the operator during the records check.There was no snow on site.The North <br /> Fork of the Gunnison River was running high and was very muddy.Bear Coal Company's water sampler,Ron Hanna,was <br /> on site. <br /> Roads <br /> The paved haul road was in good condition.However,a hole has developed in the road where the paved road meets the <br /> bridge.This hole is 2 to 3 feet deep and can easily grow in size and it should be fixed. <br /> Signs and Markers <br /> The mine id sign and its post were on the ground and need to be put back up.Surface disturbance markers were up around <br /> the disturbed area. <br /> Hydrology <br /> The water level in the sediment pond was almost up to the gated primary,which was in the closed position.There was <br /> standing water in portions of the collection ditch that leads into the sediment pond.The water in the pond and ditch may be <br /> related to the high water level in the adjoining river.However,there were no wet areas in the facilities area. <br /> The hillside spring water treatment pond was discharging the usual orange-colored water at about 10 to 15 gpm.In spite of <br /> the orange color,the discharge has been shown to be in compliance with water quality standards.The temperature of the <br /> hillside spring water was 101°F at a location about 10 feet below the origin in the hillside.The spring water was flowing <br /> into its channel,although a very small trickle is beginning to flow out of the channel towards the former office area.The <br /> flow in the channel should be completely contained. <br /> The well caps were on the two alluvial wells.The river protection berm had enough height. <br /> Facilities <br /> The front gate to the site was open.The"no trespassing"sign was on the gate.Nothing new has been done with the <br /> demolished and burned mine office. <br /> Reclamation <br /> The reclaimed haul road up to the reclaimed fan and portal adits appeared to be stable.A trickle of water was flowing out <br /> of each of the two French drains on the east side of the site,along the reclaimed road.Most of the reclaimed slopes were <br /> dry,although a few wet areas were present.The reclaimed hillside was stable and the vegetative cover was good.The <br /> backfilled portal area continues to show some signs of instability however,although some original indications of instability <br /> have been covered in dirt that is coming down from the hillside. <br /> There were several pieces of rebar still on site.Three pieces were seen on the east side of the site but west of the turn in the <br /> reclaimed road.Rebar was also seen under a large rock near the reclaimed portals.One piece of rebar was sticking out of <br /> the ground above the buried culvert leading to the hillside spring water treatment pond. <br /> Records <br /> The records were at the Bowie No.2 mine office and were in compliance,as shown on the attached records checklist. <br /> /FE�EIv�C' CopiFS or PnNb w-spFc7101V p'Ef om-r-5 <br /> c:/word/bear3/insp0408 <br />
