III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during <br /> the inspection. Comments also describe any enforcement actions taken during the inspection and the <br /> facts or evidence supporting the enforcement action. <br /> This was a Complete inspection conducted by Janet Binns of Colorado Division of Reclamation, Mining <br /> and Safety. The mine is a reclaimed surface mine. The weather was cold, windy and cloudy. Patchy <br /> snowpack remains on the permit area, runoff is actively flowing to the ponds, in the ditches and <br /> throughout the mine site. Jackson County Road 12E was dry all the way to the mine. <br /> Roads: The mine access road continues to have drifts covering the roadway. The inspector drove on the <br /> mine access road until a large drift northwest of Pond D impeded further access. The rest of the <br /> inspection continued on foot using snowshoes. No recent activity was apparent on the mine site as noted <br /> by the inaccessibility of the site. <br /> Load out: Access road to the load out was in good condition. <br /> Hydrologic Balance: Ponds A, B, D, E and F were observed. The ponds are still partially ice covered <br /> but all appear to be discharging. The discharges of Ponds F and D were accessible. Pond D was <br /> discharging slightly cloudy effluent measuring 0.66 on staff gauge at the flume. Pond F was discharging <br /> slightly cloudy effluent measuring 2"on the V-notch flume. Embankments and weirs of Ponds A, B and <br /> E were still snow covered and inaccessible. Reclaimed Pond G was undetectable under the snow. <br /> Reclaimed pond C was still snow covered but flow in drainage C was flowing in sheet flow and not <br /> ponding or channeling. Ditches are running with runoff. Drifts still cover most of the ditches. No sign <br /> of ditch failure was observed. A large snowdrift over the access road in the Pond D drainage has caused <br /> some rilling of the access road. <br /> Load out: Flooding of the center of the reclaimed area made access to the Load out pond difficult. <br /> Collection ditch contained water and snow drifts. <br /> Reve etg ation: Due to the early season, and snow just melting off, vegetation still appears to be dormant. <br /> West facing slopes are free of snow. The east side of Pit 1 is free of snow, and vegetation appears to be <br /> in good condition. <br /> Load out: Most of the snow is melted off the load out,though a few small patches remain. Vegetation at <br /> the load out appears to be in good condition. Some pooling of water is noted in the middle of the <br /> reclaimed load out. <br /> Wildlife: Animal tracks noted throughout the mine site were rabbit tracks, coyote tracks, and elk sign. <br /> The only wildlife was observed on the property during the inspection was an immature Golden eagle at <br /> the mine entrance gate, and other small songbirds. <br /> Aerial photos were collected on 4/22/2008 at 9:50 am. The aerial photos were taken a few minutes prior <br /> to the inspector arriving on the mine site. Aerial photos confirm that ponds A and B still remain mostly <br /> ice covered. These photos also show the flows in the drainages and the high water level in the receiving <br /> stream(Canadian River). <br /> 3 of 6 WHITE-File YELLOW-Operator PINK-Specialist <br />
