III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the operator <br /> during the field inspection. The reclaimed mine site was completely free of snow. <br /> Roads <br /> The road up Hubbard Creek was recently upgraded by Bowie Resources LLC for access to their Hubbard Creek <br /> vent shaft construction project. The road was in very good condition.The mine access road across Hubbard <br /> Creek was also in good condition. The access road to pond 5 was dry and passable. The Oxbow Mining LLC <br /> road across the pond 5 embankment has been reclaimed. <br /> Sins and Markers <br /> The mine ID sign and the"records location"sign were up on the closed and locked gate.The mine id sign <br /> contained the required information. <br /> Hydrology <br /> Pond 4 was completely dry. The pond embankment was stable and the spillways were functional. The road <br /> culvert that brings runoff from the reclaimed coal stockpile area to pond 4 was clear. The upland diversion ditch <br /> behind the reclaimed coal stockpile area was well vegetated. <br /> The water level in pond 5 was about 6 inches below the discharge pipe. The gated primary valve was closed. <br /> Oxbow had used the area in front of incised pond 5 for access to their methane degas holes. Oxbow reclaimed <br /> the road and regraded the pond's emergency spillway. The collection ditch leading into pond 5 had sufficient <br /> capacity. <br /> The Hubbard Creek culvert under the mine access road was functioning properly.Hubbard Creek was running <br /> high. <br /> Reclamation <br /> The reclaimed coal stockpile area had a good vegetative cover.No problems with erosion were observed. <br /> The reclaimed slopes appeared to be stable.The slopes had a good vegetative cover. There were no indications <br /> of erosional gullying or slope stability problems. There were several small areas where seeps made the ground a <br /> little wet. There was a small trickle of water coming out of the north underdrain and the south underdrain.The <br /> central underdrain had no water coming out of it,however. <br /> c:/word/bl ueribbon/insp04O8 <br />
