Box 158 <br />Carbondale, Colorado 81623 <br />RE: Sutey Refuse Pile Technical Revision, File No. C-017-81 <br />Dear Mr. Bowman: <br />Enclosed are the approval form and the publication notice for the above <br />referenced technical revision. This approval is for construction of the <br />sediment ponds, the conveyor system, the two access roads to the refuse pile <br />and the stream channel diversion. No other portions of the proposed refuse <br />pile construction plan can be started until final approval of the pending <br />permit revision. <br />Please be aware that this portion of the refuse pile construction plan is <br />being approved separately from the overall permit revision because the <br />Division believes construction of the new refuse pile is necessary to minimize <br />environmental impacts at Coal Basin, which is the subject of recent <br />enforcement actions, for the following reasons: 1) the remaining time left in <br />the construction season at Coal Basin is minimal; 2) the current permitted <br />coal refuse disposal system is less desirable environmentally; and 3) the <br />impacts of the present disposal system would be lessened. <br />This technical revision is being approved with one stipulation. The <br />cross-sections of the access road in Disney Canyon indicate that cut and fill <br />slopes will be lh:ly. This is steeper than allowed by the regulations. The <br />typical section shows these slopes to be 1.5 h:lv which is acceptable. Since <br />there is an apparent conflict, the following stipulation is necessary: <br />Stipulation No. 11 <br />PRIOR TO CONSTRUCTION OF THE ACCESS ROAD IN DISNEY CANYON, THE <br />PERMITTEE MUST EITHER COMh1IT TO CONSTRUCTION OF THE ROAD CUTS AT A <br />GRADIENT NO STEEPER THAN lh:ly IN ROCK AND 1.5h:1v IN UNCONSOLIDATED <br />MATERIAL AND COMMIT TO CONSTRUCTION OF ROAD EMBANKMENTS AT A GRADIENT <br />NO STEEPER THAN 1.5h:1v OR SUBMIT APPROPRIATE GEOTECHNICAL ANALYSES <br />• WHICH SHOW THAT THE PROPOSED ROAD CUTS HAVE A MINIMUM SAFETY FACTOR OF <br />1.5 AND THE ROAD EMBANKMENTS HAVE A MINIMUM SAFETY FACTOR OF 1.25.
