Box 158 <br />Carbondale, Colorado 81623 <br />Re: Variance From Stream Buffer Zone - File No. C-017-81 <br />Dear Mr. Bowman: <br />I have reviewed your request for a variance from the 100 foot buffer zone <br />requirement at the rock tunnel disposal area. The Division agrees with your <br />statement that changing the Dutch Creek stream channel just to maintain a 100 <br />foot buffer zone between the stream and the waste pile would be more <br />detrimental to the environment Ethan allowing disposal less than 100 feet from <br />. the present stream channel. Therefore, the Division approves a variance from <br />the 100 foot buffer zone requirement in accordance with Rule 4.05.18. <br />Since you are requesting a change in the permit, the Division must treat this <br />as a minor revision. :The form approving this revision is enclosed.
