M-200].-9b0, Amendlcxent Elppli~~ti~~, ~e~~,Adegla~cy Review. <br />Dear Mr. Baker: <br />The Division of Reclamation, Mining and Safety is currently reviewing the above referenced 112 amendment <br />application. The project appears to be a straight forward request to expand the permit area. A review of the <br />materials received from 3B Enterprises, LLC has left a few clarifications and issues that need to be addressed. <br />1) Per Rule 6.4.3(e), please specify the type of present vegetation covering the proposed affected lands. <br />2) Well permit no. 66941-F Condition of Approval # 5 states that the issuance of permit no. 66491-F cancels <br />permit no. 64121-F. Please submit proof that the operator has adequate permitting in place to accommodate <br />the proposed ground water exposure. <br />3) Well permit no. 66941-F Condition of Approval # 6 states that the total surface area of the proposed ground <br />water pond be limited to 22 acres. Please provide a figure that includes the entire proposed ground water <br />pond. The figures provided by the applicant do not clearly display the dimensions of the proposed pond and <br />do not show the entire proposed pond. <br />4) Per Rule 6.2.1, all maps must be prepared and signed by a registered land surveyor, professional engineer, <br />or other qualified person; date prepared must be shown. Please submit a Mine Plan map and Reclamation <br />Plan map that are signed and dated by the map maker. <br />5) What procedures and/or agreements will be implemented by the operator to address the Colorado Division <br />of Wildlife's recommendation for a seasonal closure of the mining operation between the dates of January 1 <br />through March 31? <br />This is the second adequacy review. Other issues may arise from other agency comments and as more information <br />is supplied. The decision date for this application has been set for May 8, 2008 provided all issues have been <br />addressed.
