Kef7relew <br />Environmental Protection Specialist <br />Division of Reclamation, Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Rm. 215 <br />Denver, CO 80203 / <br />Re: S & S Services, Lopez Quarry No. 2 (File No. M-2007-10/34) (CHS #50461) <br />Dear Mr. Keffelew: <br />Thank you for your correspondence dated June 20, 2007 (received by our office on June 2l ) <br />concerning the project listed above, genera[[y described as being located on private Land in the S W <br />'/, of the SW %s of Section 34 (T 33S R66W) in Las Animas County. <br />Based on the maps and information provided, a search of the Colorado Guttural Resource Inventory <br />indicated that two cultural resources have been rewrded within or near the proposed permit area in <br />the SW %, SW'/, of Section 3'1. Because the map that was providcd does not clearly indicate the <br />location of the 9.8 acre proposed sand/gravel pit it is not clear if either of these two sites is located <br />within the proposed permit area. In 2001 site SLA2202 was determined to be potentially eligible for <br />the National Register of Historic Places (NRHP) but a recent inventory conducted in March 2007 <br />found that the site had been destroyed by a gxavel quam. Site SLA2204 was determined eligible for <br />the NRNP in 2001 after data recovery investigations in that small portion of the site located within <br />the construction corridor for a proposed realignment of State Highway 12. The report of these <br />investigations noted that the site has the potential to yield important archaeological data. <br />We recommend that the proposed mining activities avoid site SLA2204. If site avoidance is not <br />possible, we recommend further consultation with our otTice in order to identify options to avoid, <br />minimize, or mitigate the adverse effect to the site. <br />Should human remains be discovered during mining activities the requirements under State law <br />CRS 24-80 part 13 apply and must be followed. <br />Please note that our review of your project is expedited when you indicate the extent of the <br />lic: S ~ S Services.
