Cana»y <br />pivision pireaor <br />Natural Resource Trustee <br />The Division has reviewed your 110 quarry permit application for construction <br />materials, Lopez Quarry #2, Permit # M-2007-034, and has the following comments. <br />I) EXHIBIT A & B Adequate. <br />II) EXHIBIT C Mining Plan <br />A) It is the understanding of the Division that the current affected land & <br />stockpiled material noted during the pre-operational inspection were as a result <br />of the Land owner needing a materials for his own use and that these affected <br />areas are now included in the current application. <br />B) It is also the understanding of the Division that no water either surface or <br />ground water will be either intercepted or affected by the proposed operation. <br />C) Under #17, page C-2, you stated that," No water usage is anticipated for dust <br />control". L3iven the fact that the axes will generate dust during mining & <br />reclamation, where is the water going to come from to control the dust? Under <br />Exhibit "F", you have indicated you will obtain an Air Emissions Permit, Please <br />Explain. <br />III) Exhibit D Reclamation Plan. <br />A) Under the Exhibit, you stated that the primary Post Mining land use is <br />Industrial/ commercial". After discussions with Mr. Robert Valdez Laa Animas <br />County Planning Director, after receiving his written objections, because the <br />area according to Mr. Valdez is Zoned Rural Residential rather than <br />Industrial/Commercial, you have agreed to amend your application. Please provide <br />the needed document to reflect the change to Exhibit "D". <br />B) Based on the New Poet Mining Land use, the Division has calculated the financial <br />warranty for the 9.8 acres. Please review the calculations enclosed with this <br />letter. As we discussed on 7/31/07, the calculations are based on the current <br />zoned post mining land used and divided the acreage to reflect two distinct types <br />of recalamtion to allow the construction of rural residential structures by <br />dividing the acres in two approximate equal halves. <br />C) The Division has received comments from The State Historical Society about some <br />possible unidentified Historical Sites. Their comments are included with this <br />letter.
