(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1984-028 <br />INSPECTION DATE 07/10/2007 INSPECTOR'S INITIALS DEZ <br />OBSERVATIONS <br />This routine monitoring inspection of Permit Number M-1984-028 (DiRezza Pit) was conducted by Deb E. Zack of the DRMS. <br />Dolores DiRezza was available prior to the inspection. The pit is located 7.5 miles northwest of Las Animas, CO, and currently <br />consists of approximately 9.5 acres where approximately 7 acres have been disturbed. <br />It appeared that site disturbance was localized within the approved permit area. However, while the mine entrance identification <br />sign was in place, the permit boundary markers were unclear. Therefore, per Rule 3.1.12(2) the operator must clearly mark all <br />boundaries of the affected area with monuments or other markers that are clearly visible and adequate to delineate such <br />boundaries (see Problem No.1 and the corresponding corrective action noted on page 3 of this report). The permit boundaries <br />must be marked and photos should be submitted to the Division on or before December 1, 2007. <br />Per a technical revision filed and approved in 1996, the majority of this site isused/to be used as cattle shelter/calving area. As <br />a result, these portions of the site require neither reapplication of topsoil nor revegetation. W hile portions of the site appear to <br />have been regraded to an acceptable slope (see regraded area in photos 1 and 2), other portions of the pit have nat been <br />regraded, and there are still several (possibly historic} stockpiles scattered around the rest of the site that must be smoothed <br />down to the approved flattened surface (see mounds in the distance in photos 1 and 3). The only portion of the site that <br />remains subject to the original reclamation plan is the area designated as Phase IV (at the southeastern extent of the site). This <br />portion of the site must be regraded to 3h:iv slopes or less steep, have 6 to 8 inches of topsoil reapplied, be fertilized with <br />manure, be mulched with 4000 Ibs of weed-free straw per acre, and drill seeded with the enclosed mixture. Even with what <br />appears to be poor growth media, and a lack of a vegetation requirement, there has been same decent vegetative <br />establishment across portions of the site. <br />Tamarisk was observed in a few sections of the pit (see Problem No. 2 on pg. 3} -see circled area in photos 2 and 3. The <br />Operator is advised to either treat the Tamarisk white the infestation is relatively small and localized with an approved herbicide <br />or excavate the Tamarisk while the site is being regraded. If the Operator chooses to address the Tamarisk problem during <br />reclamation while regrading the site, the Division will require a letter committing the Operator to this course of action. If the <br />Operator decides to spray or otherwise treat the Tamarisk with chemicals, then a weed control and management plan must be <br />created per Rule 3.1.10(6) on or before December 1, 2007. This plan should be developed in consultation with the county <br />extension agency, or weed control district office, and should include specific control measures to be applied, a schedule of <br />when the control measures will be applied, and apost-spray monitoring plan. <br />As a side note, the Operator is reminded that sites are required to be reclaimed within 5 years of the completion of mining (per <br />CRS 34-32.5-116(4)(q)}, Once the items listed above {and the corrective actions on page 3) are met, this site may be eligible <br />for bond release. <br />Despite the aforementioned issues, all other activities and completed work at the time of inspection appeared to foNow the <br />guidelines and regulations set forth by the state, and the mining and reclamation plans for the pit, and no additional problems <br />are noted for this site. The site appears stable and it appears that no disturbance has occurred outside of the approved permit <br />boundaries. There appears to be no vffsite erosion, and no long-term (greater than 72 hours) water retention was observed. <br />Responses to this inspection report should be directed to Deb E.
