One of the topics discussed at the meeting was our proposal to terminate jurisdiction at the Arness- <br />McGriffin site without conducting vegetation sampling. <br />We discussed the site's regulatory history, its reclamation history, its current condition and its heavy use by the <br />public. We provided OSM with an a-mail from DOW stating that maintenance of the Arness-McGriffin access <br />road is DOW's responsibility. We informed OSM that we have used all forfeited bond monies for both the Arness- <br />McGriffin site and the Coal Gulch site. We described our plan to conduct Year Nine and Year Ten sampling at the <br />Coal Gulch site this summer and next. We informed OSM of our belief that the size and condition of the Arness- <br />McGriffin site would likely preclude valid vegetation sampling at that site. We informed OSM of our plans to <br />nevertheless conduct termination of jurisdiction "bond release" inspections for both sites in the fall of 2009 <br />following Year 10 sampling at Coal Gulch. We informed them of our plans to invite whatever surface landowners <br />existed in the summer/fall of 2009 to attend the "bond release" inspections, and of our plans to follow as closely <br />as possible our regulatory procedures for termination ofjurisdiction at permitted sites. <br />After a bit of further discussion, OSM agreed to allow us to proceed with our proposal. <br />4/17/2008 <br />
