Cattany <br />Division Director <br />Natural Resource Trustee <br />In accordance with Rule 2.07.4(3)(c) of the Rules and Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining (Rules), you are hereby notified that the Division's decision to <br />Approve with Conditions the new permit application for the Northfield Mine became final on April 14, <br />2008. No requests for a Formal Board Hearing regarding our proposed decision were received. <br />Upon receipt of an acceptable Performance Bond in the amount of $470,567.00 and final clearance <br />with the U.S. Office of Surface Mining's, Applicant/Violator System, we will issue the Northfield <br />Mine permit. <br />Sincerely, <br />Kent A.
