Cattany <br />Division Director <br />Natural Resource Trus[e~e <br />The Division of Reclamation Mining and Safety received the Concerned Citizens for the Future of <br />Moffat County comments on Apri18, 2008. Thank you for taking the time to be involved in the public <br />process. Since Apri127, 2008 is the final day for comments the Concerned Citizens for the Future of <br />Moffat County comments are considered timely (see Rule 1.7.1(2) (a)). Based on the nature of the <br />comments the Division has classified them as an objection to the permit. If this is incorrect please <br />submit a,letter of clarification as soon as possible. <br />Concerned Citizens for the Future of Moffat County's comments have been forwarded to the applicant <br />by staff and the Division has asked the applicant to respond to the Concerned Citizens for the Future of <br />Moffat County letter. The Division is currently reviewing the application for adequacy. Many of <br />Concerned Citizens for the Future of Moffat County's issues are the same questions the Division <br />typically. ask for clarifications and additional information. However, please understand that issues such <br />as truck traffic, hours of operation, noise, and some local impacts are outside the jurisdiction of the <br />Division and the reclamation permit requirements. Those issues are typically addressed at the other <br />governmental agencies. Please clarify if each individual listed under Concerned Citizens for the Future <br />of Moffat County needs to be copied on correspondence or if a primary contact is preferred. <br />The Decision Date for the application is set for June 10, 2008. If Concerned Citizens for the Future of <br />Moffat County does not feel its issues have been fully addressed by that date, the Division will issue a <br />Decision Recommendation at the end of June. Staff will then schedule aPre-Hearing Conference. Per <br />Rule 2.7.;1 (5) the conference must occur at least (10) working days prior to the Mined Land <br />Reclamation Board Hearing which is scheduled tentatively for July 9-10, 2008. Therefore, the Pre- <br />Hearing Conference would be set for June. Please be aware that the applicant can request, at their <br />discretion, an extension to the Decision Date for up 365 days of when the application was considered <br />filed per Rule 1.4.1(9).
