Main St., Suite 100 <br />---- - - -Montrose,-CO 8140-1 --- --- -- -- - - - - - -- - - --- - <br />Re: Western Fuels -Colorado, LLC, New Horizon Mine (Permit No. C-1981-008) <br />2007 Vegetation Sampling for Bond Release -Alternative Statistical Approach <br />Dear Mr. Boyle: <br />The Colorado Division of Reclamation, Mining and Safety ("Division") is in receipt of your <br />letter dated O1-Apr-2008 requesting the use of a proposed alternative approach to demonstrate <br />sample adequacy for the 2007 cover data for the proposed Irrigated Pasture reference area at <br />New Horizon Mine. <br />The Division has reviewed the information detailed in the letter, and concurs with the modified <br />statistical approach and rationale presented therein. We agree that the approach presented does <br />provide a statistically adequate sample size, that the resulting estimate of the 2007 cover mean <br />for the proposed reference area would be considered statistically valid, and that the adjusted data <br />as presented would meet regulatory requirements for use in demonstration of vegetation cover <br />success in a Phase 2 or Phase 3 bond release application. <br />Please do not hesitate to contact me if you require any additional information regarding this <br />approval.
