Dear Mr. York:
On March 25, 2008, the Division of Reclamation, Mining and Safety ("Division") received your 112 Construction
Materials Reclamation Permit Application package for the Derr Pit, File No. M-2008-017. Preliminary review of the
information received determined that the following items must be received before the Division can consider your
application as being subnutted and technical review can begin:
APPLICATIOPI FORM: The Division requires the Applicant/Operator name remain consistent and matches
the exact name registered with the Secretary of State's office throughout the application. See the attached copy
of the Certification page and copy of the operators name registered with the Colorado Secretary of State's office
for additional information. Please revise the name listed on the Notary section to "Broken Arrow Investments,
LLC".
The Division requuires the dates of the Notary acknowledgement and Applicant/Operator signature match exactly
on the application form. Please revise the Certification pages so the dates match exactly.
EXHIBIT C - Plre-mining and Mining Plan Man(s) of Affected Lands (Rule 6 4 3)• One or more maps may
be necessary to legibly portray the following information:
Per Rule 6.2.1(2)'(b) maps must be prepared and signed by a registered land surveyor, professional engineer, or
other qualified person. Please submit a signed copy of Exhibit C -Mining Plan Map of Affected Lands.
EXHIBIT F -Reclamation Plan Man (Rule 6.4.6): T'he map(s) of the proposed affected land, by all phases of
the total scope of (the mining operation, shall indicate the following:
