Carter/ Mining and Safety Division Director <br />Natural Resource Trustee <br />Nuvemco, LLC. <br />10771 3200 Road <br />Hotchkiss, Colorado 81419 ~ `/ <br />Re: Last Chance 3 & 4 Mine, File No. M-2008-012, Receipt of 110(2) Hard Rock/Metal Mining <br />Reclamation Permit Application Package'~J%~ <br />Dear Mr. Carter: <br />On February 27, 2008, the Division of Reclamation, Mining and Safety received your 110(2) Hard Rock/Metal <br />Mining Reclamation Permit Application package for the Last Chance 3 & 4 Mine, File No. M-2008-012. <br />Preliminary review of the information determined that the proof of notices required in Exhibit J and the <br />Affidavit of Posting Addendum 1 needed to be submitted. On April 1, 2008 staff received correspondence that <br />was to correct these issues. The Addendum received is acceptable however there are remaining issues with the <br />notifications. The proper notices must be received before the Division can consider your application as being <br />submitted and technical review can begin: <br />EXHIBIT I -Proof of FilinE with County Clerk (Rule 6.3.9): Provide an affidavit or receipt <br />indicating the date on which the application was placed with the local County Clerk and Recorder. <br />Also, refer to Rule 1.6.2(1)(c). A statement from the applicant of placement is not sufficient to meet the <br />rules. A dated receipt from the County Clerk must be submitted. <br />EXHIBIT J -Proof of Mailing Notices of Permit Application (Rule 6.3.10): Include proof of <br />mailings of the "Notice of Permit Application" sent to the County Board of Commissioners and Board <br />of Supervisors of the local Soil Conservation District, in the application, by submitting the date-stamped <br />receipt for Certified Mailing or adate-stamped copy of the notice form with signature acknowledging <br />personal service and receipt by the appropriate board. Also, refer to Rule 1.6.2(1) (a). The notice <br />received is from the Montrose County Engineering Department and not the County Commissioners and <br />must be corrected. Staff has also noted that Nuvemco has sent out notices that the site is under <br />consideration as a 110(d). This is incorrect as it is filed as a 110(2) permit.
