(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1997-058 <br />INSPECTION DATE 02/27/08 <br />OBSERVATIONS <br />INSPECTOR'S INITIALS PSH <br />This was surety reduction request (SR-02) inspection of Baseline Resource conducted by Peter <br />Hays and Erica Crosby of the Colorado Division of Reclamation, Mining and Safety. Mr. Jim <br />McFarland and Mr. Jeff Gregg with Hall-Irwin Corporation were present during the inspection. <br />The Baseline Resource site is located approximately 1 mile north of Brighton, CO in Weld <br />County. A mine identification sign was posted at the entrance to the site. <br />The surety reduction (SR-02) request to reduce the reclamation bond for Pond No. 1 and 2 <br />slurry walls was received by the Division on February 14, 2008. The approved postmining land <br />use is developed water resources. Ponds 1 and 2 have been lined with a bentonite slurry wall <br />to prevent the migration of ground water into the pit. Hall-Irwin Corporation provided the <br />Division with a letter from the Office of the State Engineer, dated September 11, 2007, <br />documenting that the slurry walls passed the design standard for the States lining criteria <br />referenced in the August 1999 State Engineer Guidelines for Lining Criteria for Gravel Pits. <br />A surety reduction request was approved by the Division in 2000 to reduce the bond to 20~ of <br />the total slurry wall cost with the submittal of the construction observation report. The <br />reclamation liability is currently $323,750. Hall-Irwin has not provided the Division with a <br />replacement bond for the reduced amount, so the Division still holds a bond in the amount of <br />$1,314,88. Mr. McFarland was not aware of the approved surety reduction (SR-O1) and will <br />withdraw SR-02 in writing or the Division will deny the request on the decision date of April <br />14, 2008. <br />No mining activities were observed during the inspection of the Baseline Resource. All <br />mining activities have been moved to the Parker-Dersham Resource located adjacent to the <br />Baseline site. The mining in Phase 4 (expansion area) was completed in late 2007 and Mr. <br />McFarland stated reclamation will begin in early 2008. The processing facilities for Baseline <br />and Parker-Dersham remain on Phase 2D. Walker Reservoir (Phase 3) was empty; however topsoil <br />and final sloping were completed. Walker Reservoir will be seeded and filled by the City of <br />Aurora in the spring of 2008. A dividing road remains in the reservoir to mitigate landowner <br />disputes. The operator should be reminded that such change in the reclamation plan, if <br />permanent, will need to be reflected in the reclamation plan. Phases 2A and 2C have been <br />partially mined.
