(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1984-099 <br />INSPECTION DATE 4/02/08 INSPECTOR'S INITIALS ESC <br />OB38RVATION3 <br />This was a total bond release inspection of the Bailey Pit (aka Pelican Shores P.U.D) <br />conducted by Erica Crosby of the Division of Reclamation, Mining and Safety. Doug Tiefel <br />of Goose Haven Sand & Gravel and Bruce Humphries of Regulatory Permits Management, Inc. <br />were present during the inspection. <br />A total bond release request was submitted on March 17, 2008. The release request <br />included a copy of an agreement between the prior operator, J Bar B, Inc. and the Central <br />Colorado Water Conservancy District and Groundwater Management Subdistrict of the Central <br />Colorado Water conservancy District dated March 18, 1986. <br />Mining is complete on the Bailey site. The site is divided into two lakes. The lakes <br />expose groundwater, and contain lots available for residential development. The southern <br />lake is approximately 54.75 acres of exposed groundwater and contains 29 lots. To date, 8 <br />of the lots have been sold and 3 have been developed with custom built homes. Each lot <br />owner is responsible for maintenance of the property to the water line. Until the lots <br />are sold, the Home Owners Association is responsible for maintenance on the property. <br />The North Pit is approximately 49.4 acres of exposed groundwater and contains 14 lots on <br />the north edge of the site. Seven of the lots have been sold and are scheduled for <br />development. The Home Owners Association continues to reseed the vacant lots and maintain <br />the site for annual weeds. Several small islands were noted in the lake that attracts <br />various wildlife. <br />The North and South Pit are separated by the St. Vrain River. In order to stabilize the <br />banks of the river, the operator was required to reclaim the area with willow and <br />cottonwood stakes and wetland grasses to reduce or slow erosion along the channel. In <br />addition, some pit armoring was required to be in compliance with the Army Corps 404 <br />Permit. An inspection of the river verified the planting of trees, willows and other <br />wetland species. In addition rock armoring was noted along the cut bank areas as required <br />in the approved reclamation plan. <br />The site is adequate for a complete bond and reclamation liability release.
