III. COMMENTS - COMPLIANCE <br /> Eagle Mines C-1981-044 <br /> 19 March 20084�e� <br /> Below are comments on the inspection. The comments include discussion of observations <br /> made during the Inspection. Comments also describe any enforcement actions taken during <br /> the inspection and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection of the Eagle Mines conducted by Jim Stark of <br /> CDRMS. Jerry Nettleton of BTU-Empire accompanied me on the inspection. The mine <br /> is currently in ternporary cessation and is only performing maintenance and <br /> monitoring activities. The inspection was conducted on the morning of 18 March <br /> 2008. The weather was cool and sunny and the ground was covered with snow. The <br /> snow made mush of the site inaccessible for a real inspection, although I was able to <br /> get a good overview of the site. <br /> Availability of Records: All of the necessary records were available. The records were <br /> brought to the inspection in a box by Jerry Nettleton. Please see the DRMS <br /> Availability of Records form at the end of this inspection for more detailed <br /> information. <br /> Signs and Markers: - All of the necessary signs were in place as required. The <br /> entrances along Colorado Highway 13 all have their appropriate signs. Once the <br /> weather permits I will check the mine for topsoil signs and disturbed boundary signs, <br /> as required. <br /> Roads: - The mine access road was plowed and in good condition. The road is well <br /> maintained and appeared stable at the time of the inspection. There were no <br /> erosional problems noted on the road at the time of the inspection. <br /> - The roads on the west side of the mine were all covered with snow but appeared to <br /> be stable and they were all passable at the time of the inspection. <br /> Hydrologic Balance: - The only ponds that were accessible at the time of the <br /> inspection were the mine 5 dewatering ponds, 5-P5, 5-P6 and 5-P7. All of the ponds <br /> contained water at the time of the inspection. The pond embankments all <br /> appeared to be well vegetated and stable and there were no erosional problems <br /> noted on the embankments. Jerry Nettleton did indicate that muskrats have been a <br /> problem in these ponds, as they borrow into the embankments. This will be watched <br /> over the summer, once the ponds are accessible. <br /> Support Facilities: - The 5A portal area appeared to be in good condition at the time <br /> of the inspection. No problems were noted. <br /> - The other outlying mine areas were all looked at briefly but there was no way to tell <br /> overall condition as the entire area was covered with snow. These areas will be <br /> looked at in detail as ground conditions permit. <br />
