III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
This was a complete inspection conducted by Kent Gorham of the Colorado Division of
Reclamation, Mining, and Safety (Division). A final Phase III bond release application is
pending for the majority of the reclaimed area at this site. Ron Thompson of Peak Project
Management represented Basin Resources during a portion of the inspection. Ground
conditions were dry with only patchy snow mainly on north-facing slopes. The weather was
warm and breezy.
Availability of Records
The public copy of the mine records is kept at the office of Peak Project Management (PPM).
The contact, address, and phone number for PPM is Ron Thompson, Peak Project
Management, 34115 County Road 20.8, Trinidad, CO 81082, 719-846-4975. All records
were found in compliance as detailed on page 2a of this report.
Hydrologic Balance
Basin is preparing to reclaim a portion of the access road to abandoned ground water well
SF-1. Mr. Thompson and I reviewed what portions of the road would be pulled back and we
discussed leaving a portion of the road immediately under a cliff face as a bench for
protection of a gas compressor building and road downslope of this location. This short
section of roadway is becoming vegetated with grasses and small trees and shrubs. Leaving
this short section is of no environmental consequence and provides protection to buildings
and workers below.
General Mine Plan Compliance
Coal bed methane activities continue and development in and on the reclaimed area was
noted. Implementation and approval of the pending bond release application is prudent to
the nature of the current activities beyond the control of Basin Resources.
Revegetation
The growing season is just beginning with western wheatgrass and smooth brome beginning
to emerge. One observation of particular significance was the self healing of an existing
small gully on the north-facing slope of the reclaimed area. This gully now has abundant
vegetation in the bottom indicating that erosion has been reduced to the point that runoff is
successfully reduced and the vegetation has stabilized the reclaimed area. This observation
is confirmed also through vegetation cover data collected during the last two years of the
revegetation liability period.
3
