III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br /> Reclamation, Mining, and Safety (Division). A final Phase III bond release application is <br /> pending for the majority of the reclaimed area at this site. Ron Thompson of Peak Project <br /> Management represented Basin Resources during a portion of the inspection. Ground <br /> conditions were dry with only patchy snow mainly on north-facing slopes. The weather was <br /> warm and breezy. <br /> Availability of Records <br /> The public copy of the mine records is kept at the office of Peak Project Management (PPM). <br /> The contact, address, and phone number for PPM is Ron Thompson, Peak Project <br /> Management, 34115 County Road 20.8, Trinidad, CO 81082, 719-846-4975. All records <br /> were found in compliance as detailed on page 2a of this report. <br /> Hydrologic Balance <br /> Basin is preparing to reclaim a portion of the access road to abandoned ground water well <br /> SF-1. Mr. Thompson and I reviewed what portions of the road would be pulled back and we <br /> discussed leaving a portion of the road immediately under a cliff face as a bench for <br /> protection of a gas compressor building and road downslope of this location. This short <br /> section of roadway is becoming vegetated with grasses and small trees and shrubs. Leaving <br /> this short section is of no environmental consequence and provides protection to buildings <br /> and workers below. <br /> General Mine Plan Compliance <br /> Coal bed methane activities continue and development in and on the reclaimed area was <br /> noted. Implementation and approval of the pending bond release application is prudent to <br /> the nature of the current activities beyond the control of Basin Resources. <br /> Revegetation <br /> The growing season is just beginning with western wheatgrass and smooth brome beginning <br /> to emerge. One observation of particular significance was the self healing of an existing <br /> small gully on the north-facing slope of the reclaimed area. This gully now has abundant <br /> vegetation in the bottom indicating that erosion has been reduced to the point that runoff is <br /> successfully reduced and the vegetation has stabilized the reclaimed area. This observation <br /> is confirmed also through vegetation cover data collected during the last two years of the <br /> revegetation liability period. <br /> 3 <br />
