III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the inspection
and the facts or evidence supporting the enforcement action.
This was a complete inspection conducted by Kent Gorham of the Colorado Division of
Reclamation, Mining, and Safety (Division). This mine is in permanent cessation and
reclamation of most areas is complete. George Patterson of Energy Fuels Coal Inc.
accompanied me on the inspection. Mr. Patterson provided me a copy of a letter from J.R.
Phillips of Fremont County Weed Control dated March 12, 2008.
Ground conditions on this day were generally dry due to recent warm temperatures. The
weather was warm and windy.
Availability of Records
The public copy of the mine records is kept at the Energy Fuels Coal Company office in
Florence. Specific details regarding the records inspection can be found on page 2a of this
report. All records were found in compliance.
Roads
The mine access road was dry with minor rutting due to recent muddy conditions. The
operator will touch up the road and water bars once spring arrives for good.

Processing Waste _

Cover is excellent on all
areas and rills and gullies
are no longer an issue on
the pile as vegetation and healing have stopped further development of all erosional
features. EFMC has removed roof bolts used to anchor straw bales which have long since
degraded.
