III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br /> Reclamation, Mining, and Safety (Division). This mine is in permanent cessation and <br /> reclamation of most areas is complete. George Patterson of Energy Fuels Coal Inc. <br /> accompanied me on the inspection. Mr. Patterson provided me a copy of a letter from J.R. <br /> Phillips of Fremont County Weed Control dated March 12, 2008. <br /> Ground conditions on this day were generally dry due to recent warm temperatures. The <br /> weather was warm and windy. <br /> Availability of Records <br /> The public copy of the mine records is kept at the Energy Fuels Coal Company office in <br /> Florence. Specific details regarding the records inspection can be found on page 2a of this <br /> report. All records were found in compliance. <br /> Roads <br /> The mine access road was dry with minor rutting due to recent muddy conditions. The <br /> operator will touch up the road and water bars once spring arrives for good. <br /> Hydrologic Balance <br /> Two ponds remain at the R, w <br /> at udtwo main <br /> the main facility <br /> location. Pond 4 (right) <br /> at the main facility was <br /> the only pond to hold any <br /> water. All ponds <br /> appeared in good <br /> condition with no <br /> problems observed. <br /> Processing Waste _ <br /> The processing waste -'4111111111 <br /> pile is entirely reclaimed <br /> Cover is excellent on all <br /> areas and rills and gullies <br /> are no longer an issue on <br /> the pile as vegetation and healing have stopped further development of all erosional <br /> features. EFMC has removed roof bolts used to anchor straw bales which have long since <br /> degraded. <br /> 3 <br />
