The use of the C-BT Project water as a replacement source requires the Applicant to comply <br />with the Interim Rule issued by the District in May 2005 regarding the use of C-BT Project <br />water in substitute water supply plans. A copy of the District's approval letter as required by <br />paragraph I(g) of the District's May, 2005 Interim Rule was provided to this office on May 7, <br />2008. <br />8. The applicant shall maintain daily records of all diversions, replacements, and the amount of <br />water used for each particular purpose. The applicant shall provide a report of these records to <br />the division engineer and the water commissioner on a monthly basis on a form approved by <br />them. The accounting must be submitted within thirty (30) calendar days of the end of the <br />month for which the accounting is being made. <br />In addition, the applicant shall submit a report from each entity making replacements using <br />fully consumable effluent; for this plan, that entity is the City of Loveland. The report shall <br />include an accounting of all wastewater plant water effluent controlled by each entity, showing <br />the total volume of water under its control at the various wastewater treatment plants, and the <br />amount committed to each of the recipients of the water. <br />9. The name, address, and phone number of the contact person who will be responsible for the <br />operation and accounting of this plan must be provided on the accounting forms submitted to the <br />division engineer and the water commissioner. <br />10. The use of Applicant's 120 inches of the Barnes Ditch as ~a replacement source is subject to <br />the Applicant's compliance with the terms and conditions decreed in case no. 2000CW143. <br />11. Adequate accounting of diversions, cubic yards of concrete batching, tons of mined product, <br />water used for dust suppression, and replacements must be provided to the division engineer <br />and the water commissioner on a monthly basis or other interval acceptable to both of them. <br />The accounting form provided with your application is subject to modification and approval by <br />the division engineer. All amounts shall be in acre-feet, except concrete batching, which shall <br />be in cubic yards, and mined product, which shall be in tons. <br />12. This substitute water supply plan may be revoked or modified at any time should it be <br />determined that injury to other vested water rights has or will occur as a result of this plan. <br />Should this supply plan expire without renewal or be revoked prior to adjudication of a <br />permanent plan for augmentation, all use of ground water must cease immediately. <br />13. If reclamation of the mine site produces a permanent water surface exposing groundwater to <br />evaporation, an application for a plan for augmentation must be filed with the Division 1 Water <br />Court at least three years prior to the completion of mining to include, but not be limited to, <br />long-term evaporation losses and lagged depletions. If a lined pond results after reclamation, <br />replacement of lagged depletions shall continue until there is no longer an effect on stream <br />flow. Applicant has filed a plan for augmentation for the Larimer Pit and Mariana Butte Pit in <br />case no. 2000CW142. The approval of this plan does not imply a position by our office on any <br />litigation associated with case no. 2000CW142 or any other case. <br />14. Dewatering at the Larimer Pit site will produce delayed depletions to the stream system. As <br />tong as the pit is continuously dewatered, the water returned to the stream system should be <br />adequate to offset the depletions. However, once dewatering at the site ceases, the delayed <br />depletions must be addressed. At least three years prior to completion of dewatering, a plan <br />
