(a) No permit to make use of land within a SA Steep Terrain -Steep Slope - <br />Slide Area District may be issued unless the proposed use is listed an the <br />following list: <br />(1) General ranching, pasture, outdoor plant nurseries, horticulture, <br />forestry, wildlife sanctuary, game farm, and other similar agricultural, <br />wildlife, and related uses. <br />(2) Open Space, geological interest, wildlife habitat, and natural scenic <br />area. <br />(3) Play or recreation areas, and other similar uses. <br />(4) Parks, hiking or horseback-riding trails, open space, and other similar <br />private and public recreational uses. <br />(b) Any use of land is prohibited where wildfire or unstable slope materials <br />would create a public or private health or safety problem. <br />5. Preservation of natural features <br />Native vegetation and geological features may not be removed or altered. No <br />activity will be allowed which will lessen the stability of the. slopes. No activity <br />will be allowed which will increase the potential for ignition or generation of fire <br />in the SA area. No storage of any materials other than those existing or <br />growing naturally on the location will be allowed. <br />6. Construction Within Steep Terrain -Steep Slope -Slide Areas <br />6.1 No zoning, special-use, or conditional-use permit may be issued for any <br />development upon a Steep Terrain -Steep Slope -Slide Area slope <br />where the vertical height of the slope is equal to or greater than the <br />maximum allowable building height or 35 feet whichever is less. <br />6.2 No building may be constructed and no substantial improvement of an <br />existing building may take place within the buffer zone or upon any <br />designated Steep Terrain - Steep Slope - Slide Area within any <br />designated Open Space District or upon a location meeting the Steep <br />Terrain -Steep Slope -Slide Area criteria stated above where the vertical <br />height of the slope is equal to or greater than the maximum allowable <br />building height or 35 feet whichever is less. <br />6.3 For purposes of this section, "substantial improvement" means for a <br />building constructed prior to the effective date of this Ordinance, any <br />repair, reconstruction, or improvement of a building with a cost equaling <br />or exceeding 50 percent of the market value of the structure either (i) <br />before the improvement or repair is started or (ii) if the structure has been <br />damaged and is being restored, before the damage occurred. "Substantial <br />improvement" occurs when the first alteration on any wall, ceiling, floor, or <br />other structural part of the building commences, whether or not that <br />alteration affects the external dimensions of the building.
