Compliance
with Federal The West Elk Mine discharges surface water only to the North Fork of the Gunnison River. There
and State water CDRMS were no exceedances of CDPS limitations during 2006. This finding of compliance is subject to
quality laws that regulation yes verification by the CWQCD. No WET test failures occurred at outfa11017. Instream Numeric Standards for segments 2 and 6 are set forth in Rule 35 of CWQCD
regulation 5 CCR 1002. Calculated Table Value Standards for instream metal concentrations are
shown in Tables A-4 and A-5 of West Elk's discharge permit (CDPS permit CO-0038776). West
Elk discharges surface runoff and/or mine water to segments 2 and 6 via CDPS outfalls. CWQCD
based effluent limitations at these outfalls on values that would not cause exceedances of instream
standards. West Elk's compliance with its effluent limitations in 2006 indicates the instream
G. Instream CWQCC standards probably were not exceeded as a result of surface water discharges. Monitoring data from
Numeric regulation yes the North Fork at a location immediately downstream from the mine (page C-2 of 2006 AHR)
Standards 3.3.0 indicates Instream Numeric Standards were not exceeded on segments 2 and 6.
