III. PROPOSED CONCEPTUAL FINAL LAYOUT <br />Figure 3.1 shows the proposed conceptual layout of the Timnath Pit after the completion <br />of mining. The layout is based upon constraints developed through the analysis of survey, <br />wetland mitigation, elevation and economic data, as well as voiced preferences of Kehn. The <br />property has been divided up based upon three post-mining land uses, wetland mitigation, <br />development, and water storage ponds. The objective of the conceptual final layout is to provide <br />a plan that meets 'the mitigation requirements of the 404 permit, meets the preferences of Kehn, <br />and optimizes the primary post mining resource-water storage. <br />3.1 Land Use <br />The land use distribution of the final layout hinged on two primary constraints. The first <br />constraint is the 78.4 acres of compensatory wetland required by the COE. Wetland mitigation is <br />to be accomplished by using natural drainages, which have historically run through the property, <br />to provide the water necessary for wetland conditions. The wetlands were placed as shown on <br />the property to provide sufficient area, a workable stream alignment, and to maximize water <br />storage. The second constraint is the locations initially indicated to us by Kehn as being <br />earmarked for later development. These areas, totaling 35.3 acres, are indicated on Figure 3.1. <br />Refer to Figure 2.1 for a map of the development, setback and easement criteria that limit the <br />extent of mining and the mining phase map developed for the original 404 permit.
