II. LAYOUT CONSTRAINTS <br />The development of a constraint database to use for the analyses. on the Timnath Pit <br />required the colle~;tion and review of data and entering that data into a Geographic Information <br />System (GIS). Tlie initial stages of information gathering focused on maps, photos and survey <br />data of the property. Overlaying drawings of the mining plan from the 1994 Tuttle-Applegate <br />report provided a~i initial overview of the project. Survey data, including property corners and <br />elevations, provided by King Surveyors, Inc. was then added along with researched data <br />regarding setback;, utility easements, and floodplains. Figure 2.1 shows the locations of all the <br />setbacks, utility easements, and rights of way discussed in this section. <br />2.1 Setbacks :ard Right-of--Ways <br />The total area of the property containing the Timnath Pit is 280 acres. For the <br />development of the reclamation and mitigation plan, we analyzed the property based upon the <br />phased mining plan from the original Department. of the Army Mining Permit (404 permit) <br />issued by the Army Corps of Engineers (COE). After transferring the mining phase map into the <br />GIS it was deterrruned that the total combined area of the mining phases is 262 acres. The <br />18-acre difference is due to the boundary conditions around the mining area. In order to avoid <br />encroaching on neighboring property and to facilitate access to all sides of the mine a 40 to 50 <br />foot setback was established and has been maintained between the mine and the property <br />boundary where greater setbacks were not already required. Two ditches have right-of--ways that <br />reduce the minin€; area. The northern edge of the property is partially bounded by the Fossil <br />Creek Reservoir ~~utlet Ditch (Fossil Creek Outlet). The Fossil Creek Outlet has a 100-foot <br />right-of--way granl:ed by deed in 1902. The other ditch, the Arthur Lateral, clips the southwest <br />corner of the property. In accordance with the 404 permit, the outer boundary of the mining <br />operation must be; at least 100 feet away from the edge of the Cache La Poudre River (Poudre <br />River). The Poudre River flows through the upper northeast corner of the property and along the <br />upper portion of the southeast property boundary. In combination, the easements and setbacks <br />described make ul~ the combined 18 acres that reduces the total area to the mining area and sets <br />the outer boundar;~ for mining operations. <br />Other issul~s pertaining to the required setback from the river were also considered in the <br />construction of the constraints database. The Ayres Associates, Inc. report dated May 1, 1998 <br />requested by Keliul and submitted to Larimer County Engineering discusses the possible <br />hydraulic ramifia~tions of mining the Timnath Pit.
