Total consumption at the pit(s) must not exceed these aforementioned amounts unless an <br />amendment i:~ made to this plan_ <br />6. Approval of this plan is for the purposes as stated herein. This office must first approve any <br />additional uses for which the water may be used. Any future additional historic consumptive use <br />credit given (e.g., agriculture! water transfer) for this site must consider all previous credits given. <br />7. All pumping for dust control shall be measured in a manner acceptable to the Division Engineer. <br />8. The replacement water that is the subject of this plan cannot ba sold or leased to any other entity. <br />As a conditions of subssquertt renewals of this substitute water supply plan, the replacementwater <br />must be appurtenant to this site until a plan for augmentation is obtained. A copy of this approval <br />letter should Ike recorded with the County GIerK and Recorder. Ail replacement water must bs <br />concurrent with depletions fn quantity, timing, and locations. <br />9. The amount ~~nd location ofi the 151.7 acres dry-up of the irrigated pasture associated with the <br />Applicants shares of the Sox Elder Ditch must be documented and appraveq by the division <br />engineer and water commissioner before any consumptive use credits are available for use under <br />thls plan. As pert of the documentation process a map and legal description of the dry-up was <br />submitted to the State Engineer an dune 21, 2004. <br />10. Adequate accvaunting of depletions and replacement must be provided to the division engineer in <br />oreelay and 1~ha water commissioner on a monthly basis or other interval acceptable to both of <br />them. The accounting farm provided with your application is subject to modification and approval <br />by the division engineer. All amounts shall be in acre-feet. <br />11. The name, address, and phone number of the contact person who will be raspansible far the <br />operation and accounting of this plan must be provided on the accounting farms to the division <br />engineer and water commissioner. <br />12. If reclamation of the mine site wilt produce a permanent water surtace exposing groundwater to <br />avaparatian, an application for a plan far augmentation must be flied with the Division 1 Water Court <br />at least three years prior to the completion of mining to indude, but not be limited to, long-term <br />evaporation losses and lagged depletions. K a lined pond results after reclamation, replacement of <br />tagged deplatiana shall continue until there is no longer an effect on stream flow. An application for a <br />plan for augmentation was filed with the Division 1 Water CouR in case no. 2004CWQ06. Granting of <br />this plan doe, not imply approval by this office of any such court applications}. <br />13. This substitute water supply plan maybe revoked ar mod~ed at any time should it be determined <br />that injury to other vested water rights has or will occur as a result of this plan. Should this <br />substitute wGltsr supply plan expire without renewal or be revoked prior to adjudication of a <br />permanent phan for augmentation, ail excavation of product from below the water table and ail <br />other use of ~~vatar at the pit must cease immediately. <br />14. In accordance with amendments to §25-8-202(7}, G.R.S., and Senate Bill 88-181 Rules and <br />Regulations .adopted on February 4, 1992, the State Engineer shall determine if the substitute <br />supply is of a quality to meat requirements of use to which the senior appropriation receiving the <br />substituted supply has normally been put.
