Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Reclamation, Mining, and Safety (Division) is in receipt of your comments, dated <br />March 14, 2008, related to the application for the McStone Aggregate LLC, Mud Creek Pit reclamation <br />permit. The Division is not clear as to whether the comments submitted are guidelines which the <br />Mancos Conservations District would like to have considered during the review process of the permit <br />application or whet]Zer they are objections to issuance of a permit. Some of the items cited in the letter <br />do fall within the jurisdiction of the Division and will be considered during the application review. <br />Others, however, do not fall within the jurisdiction of the Division, such as issues related to air quality <br />and traffic, and cam>,ot be considered by the Division during the review process. <br />If the Mancos Conservation District would like to consider the submitted comments as objections to <br />issuance of the permit, a representative of the District will be invited to participate in a public hearing <br />before the Mined Land Reclamation Board to present its case against issuance of the permit. A pre- <br />hearing conference will be scheduled prior to the Board hearing to identify which issues will be <br />addressed and to develop a schedule for the hearing itself. <br />The Division, however, will need clarification from the Mancos Conservation District as to whether its <br />comments are requests for consideration or are objections to issuance of the permit.
