Cattany <br />Division Director <br />Natural Resource Trustee <br />On March 20, 2008, the Division received a map of the Ruby Trust Mine, prepared and certified <br />by Stephen C. Fearrl, P.E. Colorado 11244 and dated March 8, 2008. The map certifies that the <br />patented portion of the Ruby Trust No. 2, US survey 2496, is outside of the permit boundary. <br />The Durango Office does not have the capability to reproduce oversized maps and has sent the <br />map to the Denver Office for filing and reproduction. Upon receipt of a copy of the map from <br />Denver the Division will forward the map to you for your records. <br />Therefore, the issues raised in your second complaint appear to have been addressed by Mount <br />Sneffels Mining Company and the Division considers these proceedings of alleged trespass to be <br />closed. <br />However, should you disagree with the Division's determination, please submit a petition for <br />Administrative Appeal in accordance with the provisions of Rule 1.4.11 of the Mineral Rules and <br />Regulations of the Colorado Mined Land Reclamation Board for Hard Rock, Metal and <br />Designated Mining Operations, which can be accessed at our website, http://mining.state.co.us/. <br />Please note that pursuant to Rule 1.4.11(1)(b), the petition must be received by the Division by <br />April 23, 2008. <br />Please contact me at the Division's office in Durango at 701 Camino del Rio, Room 315, <br />Durango, CO 81301, phone (970) 247-5469, if you have any questions. <br />Sincerely,` <br />Wallace H.
