• PROPOSED WATER PLAN <br />The water pumped to dewater the mine may be utilized in the mining process in quantities sufficient to allow <br />maximum projected mining levels without causing injury to downstream water users. Under existing <br />conditions on Chandler Creek and the unnamed drainages, these small volumes are likely not practically <br />available for downstream senior water users and if not used in the mining process, would be "wasted" to the <br />dry, losing stream. Nevertheless, the State Engineer's Office will require an augmentation plan to replace <br />depletion to the system. <br />Standard Imposed by M.L.R. Regulation 2.04.7(3) <br />Colorado Mined Land Reclamation Boazd Regulation 2.04.7(3) provides as follows: <br />Alternative Water Supply Information. The application shall identify the extent to which the proposed <br />surface coal mining operations may proximately result in contamination, diminution, or interruption of <br />an underground or surface source of water within the proposed permit azea and adjacent azeas for <br />domestic, agricultural, industrial, fish and wildlife, or other legitimate use. If contamination <br />diminution, or interruption may result, then the description shall identify the alternative sources of <br />water supply or sources of augmentation water that could be developed to replace the existing sources <br />(See Article 83 and 92 of Title 73 of the 1973 Colorado Revised Statutes). <br />Based on the available information, the proposed Northfield mining operations will not adversely impact or <br />interrupt water usage in the area for domestic, agricultural, industrial, fish and wildlife, or other legitimate use. <br />An augmentation plan will be required to meet the water rights requirements for the Arkansas River rules and <br />regulations. No specific alternative sources have been identified at this level of study, although various sources <br />of augmentation water are available in the Arkansas River basin. There is no significant interruption in water <br />supply anticipated due to the mine operations. <br />• -22- <br />
