• • <br />fees and expenses of litigation, arising out of or resulting from Lessee's activities under this <br />option. during the option period, any extension thereof and any reclamation as provided in <br />paragraph 7, below, and the existence of this Option Agreement. ' ' <br />5. DEFAULT BY LESSEE. In the event of any default by Lessee during the option period or <br />any extension thereof of any provision of this Option, Lessor may give to Lessee a written <br />notice specifying such default and if, within thirty (30) days from written notice thereof by <br />Lessor in the manner set forth in paragraph 14 of the attached Lease, Lessee shall not have <br />remedied such default in a reasonable manner, then, at the expiration of such thirty (30) day <br />notice period, Lessor may, by further written notice to Lessee, may terminate this Option. <br />6. RECLAMATION AND RELATED WORK. In the event this Option is not exercised by <br />Lessee, Lessee shall nevertheless remain responsible and liable for all reclamation and <br />related work arising out of its activities on the Leased Premises and Lessee shall be afforded <br />reasonable access to and use of the Leased Premises for the performance of its obligations <br />under this paragraph. <br />7. INDEMNIFICATION AND PERFORMANCE BY LESSEE. The agreements of Lessee as <br />set forth in this Option Agreement shall survive the option period and any extension thereof <br />and any expiration or termination thereof for any reason. DurinV the period of this Option <br />and anv extension thereof and durin any reclamation and related .work period as provided in <br />paragraph 6, above. Lessee will reimburse and indemnify Lessor all as set forth in paragraph <br />4, above, and carri~ the same minimum public liability insurance set out in paray~raph 8 of the <br />Lease and on the same terms as set out in paragnaph 8 of the Lease. <br />8. LIMITATION ON LIABILITIES OF LESSOR. Lessor shall not be responsible for any <br />losses, liabilities or damages which Lessee may suffer in connection with its activities or <br />operation on the Leased Premises unless such losses, liabilities or damages (i) shall have <br />,'r`b~ <br />
