• • <br />occurred by reason of some grossly negligent or intentionally wrongful act on the part of <br />Lessor, or (ii) shall be the result of an act of the Lessor committed to violation of an <br />obligation of the Lessor under a provision of this Option Agreement or, after- the Lease <br />attached hereto shall have been executed and activated, of an obligation of Lessee under the <br />Lease; provided, however, that nothing contained in this paragraph shall impose any duties or <br />liabilities on the Lessor in addition to those which otherwise would exist at law or under this <br />Option Agreement or under the Lease. <br />9. EXECUTION OF LEASE. In the event the option granted herein be exercised, the Lessor <br />shall, within thirty (30) days of the giving by Lessee of the notice required in paragraph 2.1, <br />above, execute in recordable form and deliver to Lessee two copies of the Lease currently <br />dated. Within five (5) days from the receipt of such executed copies, Lessee shall execute in <br />recordable form and deliver to Lessor one of the two copies of the Lease executed by the <br />Lessor under the requirements of the next preceding sentence. <br />10. NON-ASSIGNABILITY. This Option Agreement and the option granted herein may not be <br />assigned by Lessee without the written consent of the Lessor first given in writing, but such <br />consent shall not be unreasonably ~~~thheld. Any such consented to or unconsented to <br />assigning shall not relieve Lessee in an_y way of its .obligations hereunder. The provisions of <br />this paragraph, however, shall in no wa~~ qualif<j or impair the right of assignment, subletting <br />or contracting granted to Lessee as Lessee in paragraph 1 ~ of the Lease. <br />11. SURVIVING OF LESSEE'S COVEiv`ANTS. All covenants and agreements set forth in <br />This Option Agreement to be performed by Lessee shall survive This Option Agreement. <br />1?. NOTICES.
