Division of Reclamation, Mining and Safety ("DRMS") Permit

Dear Ms. Linden:
As you know, we represent Northfield Partners, LLC ("Northfield") with respect to the
pending permit application before the DRMS.
The legal and equitable owner of the property to be affected by surface operations in the
permit area is Chandler Creek Companies c/o Gus J. and Daniel L. Slanovich. Those who have
legal or equitable rights to the minerals are Chandler Creek Companies c/o Gus J. and Daniel L.
Slanovich; Myron F. Smith, Senior; and Daniel Adamic, Marie Adamic and Betty Adamic.
As is apparent by the application, there are a few surface areas impacted but not directly
disturbed by Northfield's proposal to mine. As set forth above, any actual surface disturbance
may only occur on the property owned by Gus J. Slanovich and Daniel L. Slanovich. The portal
and facility relative to the operations are already designed and "platted" via Fremont County
Conditional Use Permit on the Gus J. and Daniel L. Slanovich property.

The owners of the surface and subsurface areas contiguous to the permit area are as
follows: (1) Daniel Adamic, Marie Adamic and Betty Adamic; (2) John L. and John Paul Ary
(who own the surface only); (3) Myron Smith, Sr. (coal only); (4) Gary and Karen Zak (surface
only); (5) Michael Gilliam (surface only); (6) Sue Popkess-Vawter (surface only); (7) Chandler
Creek Companies; (8) Cotter Corporation (surface only in Section 14); (9) Peabody Western
Coal (minerals only in Section 14); (10) Theodore and Kelee Dell (surface only); (11) Dennis
and Roxye Hamilton (surface only); and (12) John and Carie Rutherford (surface only). The
right of entry and operation information is further delineated in Section 2.03.06 in the pending
application. It is highly unlikely that Northfield will affect the surface of the above parties,
particularly in that the proposed mining operation is underground.
