III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Marcia Talvitie and Mike Boulay of the Colorado <br />DRMS. Mr. Dave Andrews, representing the operator, was present during the field inspection of <br />Pond B. <br />Signs and Markers <br />A Mine Identification sign was posted on the County Road at the mine entrance, per the <br />requirements of subsection 4.02.02. Smaller signs were posted at appropriate locations <br />throughout the permit area. <br />Roads <br />The muddy road conditions that prevented access to the mine during the February 2008 <br />inspection had dried out. Mine Areas 1 and 3, and Ponds A and B were accessible by vehicle. <br />Hydroloaic Balance <br />Sedimentation Pond A - Snowmelt has dccumulated along the low point at the northern end of <br />the pond, against the embankment (Photo 1). The surface area of the water is estimated to be <br />approximately 0.25 acres. <br />Sedimentation Pond B -Runoff from the winter's unusually heavy snow had resulted in <br />impoundment of approximately one acre of surface area, and up to six feet in depth. <br />According to the landowner, this is the most water the pond has held since its construction <br />(Photo 2). <br />Impoundment structures for both ponds appeared to be stable and were functioning as <br />designed. There was no evidence of recent discharge from either pond. <br />Revegetation <br />Mine Areas 1 and 3 were both clear of snow. No seasonal growth had yet begun. <br />Tamarisk communities were observed in both ponds. They appear to be well established. <br />
