III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations\made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the <br /> operator,Bear Coal Company, during the inspection.Most of the flat reclaimed facilities area was clear of snow <br /> but was very wet from snowmelt. The hillside area of the reclaimed mine site was covered in snow. <br /> Roads <br /> The paved haul road was almost clear of snow.The road was passable. The bridge was partially covered in <br /> snow but was also passable. <br /> Facilities <br /> The entrance gate was wide open and should be locked.The mine office had been demolished and burned in <br /> place. The debris has not been dealt with yet. The concrete footers of the building and the concrete slab need to <br /> be broken up and buried in place. <br /> Hydrology <br /> The hillside spring water treatment pond was discharging the usual orange-colored water at about 10 to 15 <br /> gallons per minute.The orange-colored discharge has been shown to be in compliance with water quality <br /> standards. The water level in the treatment pond was about 8 inches below the horizontal discharge pipe. The <br /> hillside spring that feeds into this treatment pond was flowing in its channel. <br /> The primary discharge pipe gated valve of the sediment pond was in the closed position. The waterlevel in this <br /> pond was about eight inches below the gated valve level.The pond embankment appeared to be stable. The <br /> collection ditch leading into this pond had ample capacity. <br /> The culvert under the road at the entrance gate was functioning properly. The river diversion berm had sufficient <br /> height. There were no problems noted with the two alluvial wells.Both well caps were in place. <br /> Sims and Markers <br /> The mine ID sign and post were on the ground and should be put back up.The"no trespassing"sign was up on <br /> the entrance gate. <br /> c:/word/bear3/insp0308 <br />
