III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> The operator was placing and spreading coal waste on gob pile no.4,which is located in the middle section of <br /> the gob pile area.The coal waste was still a little wet so it may be left there for some additional drying. There <br /> were no new additions to gob pile no. 1, which is on the extreme west side of the gob pile area.There were still <br /> a few small gob piles drying out on the top of gob pile no 2,which is on the east side of the gob pile area. <br /> Surface disturbance markers were up around the area. <br /> Pond D had a little water in it while the water level in pond C was about 6 feet below the elevation of the <br /> emergency spillway. Surface disturbance markers were up. The inlet of the culvert going into pond D could use <br /> some maintenance soon,although it was still functional. Silt fence probably could be extended westward on the <br /> east side of pond D,along the outside edge of the haul road. <br /> Unit Train Loadout <br /> The material storage areas along side and under the conveyor that leads from the transfer tower down to the <br /> train loadout were in order.Most of the silt fence was in very good condition. Some of the silt fence,however, <br /> could use some normal spring maintenance. <br /> There was a string of empty coal cars on site.No coal loading was taking place. During the inspection,an empty <br /> unit train came in for loading.No problems were noted with any of the loadout facilities.No fugitive dust <br /> problems were observed. The loadout bench outslope had a good vegetative cover and appeared to be stable. <br /> Collection ditches and culverts had sufficient capacity. Upland diversion ditches and culverts were also <br /> functional. There was no water in pond J.The primary discharge pipe valve was closed. The emergency <br /> spillway was functional.Pond K did not have any water in it but it did have a blackish color on the bottom of <br /> the pond due to previous wash down water. The pond embankment was stable and the spillways were <br /> functional. Surface disturbance markers were up. <br /> The extreme west end of the loadout bench was stable as well.Water was passing out of the railroad culverts <br /> from the french drain beneath the tracks.The water was coming from snowmelt in the pasture up gradient of the <br /> track bench. The outslope of the bench was well grassed. <br /> Hubbard Creek Vent Shaft <br /> The operator has been working on maintaining the county road up to the shaft construction site. Some portions <br /> of the road are being widened to accommodate the shaft drilling machine. On Forest Service land,the road has <br /> been graveled with a filter fabric underneath. Straw bales and silt fence were in place for sediment control, <br /> although snow covered most of the silt fence. <br /> Work was continuing on the shaft site. The pad has been constructed and was fairly dry. The contractor was <br /> drilling holes and injecting cement around the future shaft site to control ground water.There was only a little <br /> snow melt in the mud pit. The upland diversion ditch was snow covered,as was that portion of the rock <br /> catchment berm that has been constructed so far.Mine ID signs and stream buffer zone signs were up. Surface <br /> disturbance markers were also present. <br /> Records <br /> The records were in compliance, as documented on the attached records checklist. <br /> c:/word/bowie2/insp03 08 <br /> 2 <br />
