D) The applicant states;' it will be in compliance with all Federal and Colorado dredge and fill <br />regulatory requirements:' The Division as stated earlier is a bit confused, the purpose of placing a <br />slurry wall and dewatering the pit is to mine it dry. Please explain. <br />E) The applicant proposes to build a 20 foot and 15 foot dam embankment, which requires prior <br />approval from the Division of Water Resources Dam Safety branch. In addition, DRMS will need a <br />copy of the ~ipproved plan, design so if additional warranty is needed. It is the understanding of the <br />Division that these dams will be permanent structures and will not have to be removed as part of <br />the post mining land use and all part of the DAM will be incised. Please explain. <br />F) It is the undE~rstanding of the Division, all GW wells noted during the per-operational Inspection <br />belonged to the applicant. Please verify. <br />V) Exhibits '"H", "I";'J" & "K" Adequate <br />V) Exhibit "I." Reclamation Cost <br />A) As stated earlier, in order for DBMS to calculate the required warranty, the requested information <br />has to be provided. Even though the applicant has provided a cost summary, under the Exhibit, it is <br />not based on actual design for the slurry wall and dams and can not be accepted as the TRUE cost <br />needed to reclaim the site in the event DRMS has to contract it to another company to complete the <br />task. <br />VI) Exhibits "]VI" THRU "S" <br />A) These Exhibits need to be labeled correctly. Per our phone conversation, please provide another <br />copy of the application labeled correctly, preferably, the Exhibit label should be placed at the top of <br />the page rather than the bottom. This way the applicant will be able to see if the appropriate label <br />is reflected far each Exhibit and avoid the mistake. <br />VII) Exhibit "S''' Permanent Man Made Structures. <br />A) Has the operator identified all man made structures with in 200 feet of the permit area? Please <br />verify. <br />The division has received your written 90 day decision waiver for your application and has extended <br />the decision date firom 4/16/08 to 6/16/08.
