("Applicant") in accordance with Section §37-90-137(11), C.R.S. An amendment to that request was submitted on April 26, 2006. The applicant shall be responsible for compliance with this plan, but the State Engineer's Office may also pursue the landowner for eventual compliance. The required fee of $1,343 for the original SWSP has been paid (receipt no. 3600664) and a fee of $217 has been paid to amend the SWSP (receipt no. 3603210). Plan Operation This plan seeks to replace depletions resulting from mining at the Lupton Lakes Resource Pit ("Lupton Lakes°). The depletions that result from the mining operation are evaporation, water lost in mined product, concrete hatching and dust suppression. The applicant is currently planning to wet mine the site, however, if they decide to dewater and dry mine the site, depletions will also result from the dewatering operation. The amended request specifies that wells 19490S, 7280R, 20317R, 1408R, 2819F, 1657RR, 2820F, 20583R, 12800R and 19944RF will be used to provide process water to the mining operation. All of the wells are located within the gravel permit boundary in sections 18 and 19, Township 1 North, Range 66 West, 6th P.M.
