Under the supervision of Brian D. Len, P.E., Robert J. <br />Peterson from NWCC Inc. conducted the inspection on two dates: September 15 and October 23, <br />2007. The purpose of the inspection was to provide annual certification by a Professional Engineer <br />registered in the state of Cotorado. The inspection included Ponds A, B, D, E and F for the mine <br />area and the pond situated at the Tipple. Note that ponds C and G were reclaimed during the <br />summer 2006. The inspection forms are attached for each pond and the results of the inspection <br />are summarized below. Photographs taken during the inspection are available upon request. <br />A11 ponds, embankments and spillways were functioning as designed and intended. All ponds <br />contained water except for Pond F which was dry. Ponds A, B and D wa#er levels were 2 to 3 feet <br />below the primary outlet elevation. Pond E and the Tipple water levels were less than 1 foot below <br />the outlet. Discharge was only observed at the Tipple pond weir. This was likely due to seepage <br />from the nearby irrigation ditch, which was flowing. For each pond, we observed both sides of <br />each embankment, the crest, the primary and emergency spillway structures, the outlet pipes, <br />weirs and discharge areas. Kerr has removed a lot of the sage brush and other bush vegetation <br />from the emergency outlets. There are no actions required for any pond for immediate health or <br />safety concerns. For long term maintenance, we have made some relatively minor <br />recommendations for action items associated with the 5 ponds remaining at the mine. These are <br />all considered permanent ponds (Ponds A, B, D; E and F). The recommendations were made to <br />maintain or improve the function and safety of the dam/pond and are noted on each pond <br />inspection form. The key maintenance item for the Tipple Pond, removal of the vegetation in the <br />secondary outlet was completed in 2007. _ <br />Please contact the undersigned with questions or comments on the inspections. <br />Sincerely, <br />NWGC, INC. <br />Robert J.
