III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This partial inspection was conducted by Joe Dudash and Marcia Talvitie of the Colorado DRMS. Jim <br /> Kiger represented the operator during the field inspection. <br /> The mine ID sign was up at the entrance to the site.No problems with fugitive dust were observed at <br /> the silo area, although no coal rail cars were on site or being loaded during the inspection. There was a <br /> little ice-covered water in pond A, which is located at the entrance to the mine site. The water in pond <br /> B was also covered in ice but the pond was not discharging. Surface disturbance markers were up <br /> around the disturbed areas of the mine site. <br /> The haul road leading to the Elk Creek Mine facilities was in good condition. The road ditches had <br /> sufficient capacity and the road berm was in place. No problems with fugitive dust were noted at the <br /> screener/crushing facility. There were no problems at the water tank and water treatment facilities <br /> either. <br /> There was a large volume of coal that was stockpiled at the stacker tubes. No problems with fugitive <br /> dust were observed. Just north of the coal stockpile,pond D was ice covered but was discharging clear <br /> water into the Elk Creek culvert. No issues were noted with the cap and powder houses that are located <br /> between pond D and the coal stockpile. <br /> There were no problems with any of the Elk Creek Mine facilities, including the fuel facility. The <br /> topsoil stockpile was covered in snow. The small slide near the rock dust storage tank had been <br /> stabilized with rocks placed at the toe of the slide. However,the large slide on the west side of the <br /> facilities area continues to slowly creep downward. <br /> The material storage at the east yard was in order. The east yard refuse pile appeared to be stable.No <br /> gullying or slumping was observed on the refuse pile's outslope. The berm on the outside edge of the <br /> east yard bench was in place. Surface disturbance markers were up. <br /> The road to the reclaimed Sanborn Creek Mine was in good condition and was passable. At the <br /> Sanborn Creek substation no. 3 area,the sediment pond was snow covered. There was no rilling on the <br /> topsoil stockpile.
