DRAFT FOR REVIEW <br />Should obviously suspicious subsurface materials be encountered either visually or by odor <br />in our geotechnical test borings, such borings will be immediately terminated. Kleinfelder <br />will notify you as soon as possible of such an occurrence, and we will both mutually decide <br />whether to continue, modify or cease the remainder of the drilling program, and whether an <br />expanded environmental assessment should be conducted. All added costs incurred as a <br />result of suspected hazardous substances would be charged on a time-and-expense basis <br />over and above the established fees for the site investigation. <br />SITE CLEARANCE <br />Before drilling on-site for this study, all utilities and utility easements should be accurately <br />located. This information should be made available to Kleinfelder at least finro days before <br />beginning our field investigation. This can best be done by the owner of the properly or <br />specific utility through a review of title documents and project drawings. <br />We also recommend that the approximate limits of the proposed excavations along the <br />canal be staked in the field prior to beginning our field investigation. We wil! notify the Utility <br />Notification Center of Colorado (UIVCC) so the member utility companies within pertinent <br />public rights of way and utility easements can mark their facilities prior to our field <br />investigation. <br />Please be aware that penetrating the site surface is inherently risky. It is impossible to <br />determine with certainty the precise location of all structures including utilities that may be <br />buried in the ground. Disruption of utilities or damage to underground structures not <br />properly marked in the field by the utility owner will be the responsibility of the utility owner. <br />The fees charged by Kleinfelder are inadequate to compensate for both the performance of <br />the services and the assumption of risk of damage to such underground structures. <br />Therefore, the disruption of utilities or damage to underground structures will be the <br />responsibility of the owner.
