The <br />Mining Plan and Reclamation Plan have been revised in order to acquiesce to the Rocky <br />Ford High Line Canal Company needs. The Rocky Ford High Line Canal Company and <br />the applicant have negotiated the items that the Canal Company would like to see <br />changed as a result the operator/applicant has agreed to the following. The change will <br />reduce the phases from four {4) down to three {3} and that mining would start on the <br />south side of the canal. Both parties also agreed that mining would not start on the north <br />side until the ditch company agreed to the structural stability report done by Kleinfelder, <br />Inc. a geo-technical engineering company. Then after reviewing the stability report <br />Rocky Ford High Line Canal Company and the applicant would then set the no mining <br />buffer zone adjacent to the ditch. Another item that was revised is that under the bridge in <br />lieu of two {2) feet free board four {4) feet would work better for the ditch company this <br />was agreed to by the applicant. The bridge will be installed over the Canal with <br />permission from the Rocky Ford High Line Canal Company. The ditch company will <br />grant an easement and approve the placement of the bridge and also for the haul road that <br />is on the north side of the ditch and bisects the 200 feet no mining set back. Mining will <br />start on the south side of the ditch. The Reclamation Plan Map has also been revised to <br />reflect the changes mentioned above.
