Dear Ms. Zack:
As we discussed, enclosed are portions of the decree in Case No. 02CW181, approved
by the Water Court on March 2, 2007 for the Lower Arkansas Water Management Association
(LAWMA). The decree provides a plan for augmentation for the LAWMA structures specified in
Exhibit Q, of which the Midwestern Farms Resources (M-93-59) gravel pit operation is included.

As the LAWMA decree provides a. permanent ,augmentation plan, the submittal and
approval of a temporary substitute supply plan,, through the Office of the State Engineer is no
longer required.
