RECEIVED
MAR 18 2008
Division ni Keclamation, t~O
Mining and Safety
Response to Reclamation Permit Application Consideration
DATE: March 18., 2008
TO: Tom Kal~ienbach, Environmental Protection Specialist
CC: Division 7 Office; District 30 Water Commissioner
FROM: Don West, P.E.
RE: Carbon Junction Mine Pit, File No. M-1992-080
Operator: Oakridge Energy, Inc.
Contact: Oakridge energy, Inc.
Section 33, Twp 35N, Rng 9W, NM P.M., La Plata County
CONDITIONS FOR APPROVAL
^ The proposed operation does not anticipate exposing groundwater. Therefore, exposure of ground
water must not occur during or after mining operations. If stormwater is contained on-site, it must
infiltrate into the ground or be released to the natural stream system within 72 hours, or all work
must cease ur.~til a substitute water supply plan, or augmentation plan approved by water court, is
obtained. Reclamation plans must ensure water will not be retained onsite for more than 72 hours
unless an augmentation plan approved by water court is obtained.
® The proposed operation will consume ground water by: ^ evaporation, ^ dust control,
^ reclamation, ^ water removed in the mined product, ^ processing, ®other:.Storage
A new water .report has not been submitted with the application; therefore, all water uses can not be
identified. However, applicant in the past has stored water and obtained an NPDES permit. The
location of tht; mine site appears to be in a location where water is available for appropriation.
^ Prior to approving a well permit, the applicant must conduct a field inspection of the site and
document the locations of all wells within 600 feet of the permit area. The applicant must then
obtain a waiver of objection from all well owners with wells within 600 feet of the permit area or
request a hearing before the State Engineer.
^ Other:
COMMENTS: Applicant should file for a new water right for water uses at the site so that the water right
can be assigned a priority. The water right priority could become a necessity for diversions to the site if the
location should ever become over appropriated.
