III. COMMENTS- COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a complete inspection conducted by Joe Dudash and Marcia Talvitie of the Colorado DRMS. Jim <br /> Kiger represented the Terror Creek Company. There had been a recent heavy snowfall and about half of the <br /> loadout was still covered in snow. However,the snow was melting rapidly. <br /> Roads <br /> The main paved entrance road was in good condition.The guard rail was up.The graveled east side entrance <br /> road was in good condition as well.The east side entrance gate was open. The light use road along the railroad <br /> tracks was snow covered but passable. <br /> Signs and Markers <br /> The mine ID signs contained the required information. The signs are located at the main entrance,the east side <br /> entrance and near the railroad tracks. The perimeter boundary signs were up along the permit boundary. <br /> Facilities <br /> There were no problems observed at the mine office, shop, scale,truck unloading and railcar loading structures, <br /> substation and fuel facilities. There were only a few pieces of equipment at the material storage area. There was <br /> a moderate amount of stockpiled coal on the facilities bench. With coal trucks unloading and railcars being <br /> loaded,there were no signs of fugitive dust offsite.No coal fines were on the highway at the loadout entrance. <br /> Hydrology <br /> The east side sediment pond had water to within one foot of the primary discharge tube. The gated valve on the <br /> pipe was in the closed position.The pond embankment was snow covered but appeared to be stable. The west <br /> side dugout pond was clear of snow but had no water in it. <br /> Some of the culvert inlets and outlets were covered in snow.The outlet of the culvert that lies east of the"Nale <br /> was functional but could use some cleaning soon.The collection ditches were mostly covered in snow but . \ <br /> appeared to have enough capacity. The straw bales and silt fence were in position along the railroad track small <br /> area exemption. <br /> Topsoil <br /> The east side topsoil stockpile was partially covered in snow but no rills were observed. The collection and <br /> diversion ditches were functional.The topsoil sign was up on the stockpile.The west side topsoil stockpile was <br /> clear of snow on the south facing slope. The topsoil stockpile sign was up. <br /> Records <br /> The required records were on site,as documented on the attached records checklist. <br /> c:/word/terror/insp0208 <br />
