provide their analysis of the need (or lack thereof) for a point of compliance for alluvial <br />groundwater, in the form of a Technical Revision, to the Division no later than 31 July <br />2008. The Division would like Colowyo to confirm whether or not this date works for <br />them and, if'not, to propose an alternate date for providing this information to the <br />Division. <br />The third item on the agenda was to discuss the overall Colowyo hydrologic monitoring <br />plan. It was determined that the plan was discussed at length when we discussed alluvial <br />wells A7 and A8 and the points of compliance discussion and that no further discussion <br />was warranted at this point. <br />The fourth and final item that was discussed was the Divisions concerns with the <br />Prospect Pond and the Prospect drainage. Basically, the Division believes that there is <br />the possibility that there could be major erosional problems, extreme sedimentation and a <br />possible pond embankment failure at the Prospect Pond. At issue is the SEDCAD model <br />that was used to size the Prospect Pond. This model breaks the Prospect watershed up <br />into several different subwatersheds based on the reclamation stage they are in. These <br />stages are newly regraded and topsoiled, reseeded 1-2 years and reseeded 3+ years. The <br />model is very clear as to how many acres can be in each of these three stages of <br />reclamation. <br />It is the Division's position that the spoil regrading map is very vague as to when the East <br />Pit will be regraded and when final closure will occur and that not adhering to the <br />approved SEDCAD design for the pond could be catastrauphic. The Division has asked <br />Colowyo to provide a more detailed description and timing of the final regrading and <br />closure of the East Pit, including a map or plate and acreages of each regrade area, to <br />ensure that it will conform with the approved design and the SEDCAD modeling. <br />Additionally, the Division has also requested that Colowyo provide a more detailed <br />description of any alternate sediment control measures that it will use in the East Pit <br />reclamation. 'T'his information will allow the Division to more accurately assess the East <br />Pit reclamation and give the Division a higher level of confidence with regards to the <br />Prospect drainage and the Prospect Pond. <br />The issues regarding the Prospect drainage and the Prospect Pond were initially <br />addressed in the Colowyo Permit Renewa105 preliminary adequacy review letter, dated <br />20 August 2007, question 10. It would be appropriate for Colowyo to respond to the <br />concerns in the Permit Renewal. Additionally, the proposed decision date has passed for <br />Permit Renewa105. Please request a 60-day extension for the decision date. <br />This concludes; the items that were discussed at the 26 February 2008 meeting. The <br />Division believes that there is now a plan for addressing all of the above issues. Each <br />issue has its own timeframe for resolution that was agreed upon at the meeting.
