M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting-the enforcement action. <br /> This was a complete inspection of the Seneca II Mine conducted on February 27, 2008 by Mike <br /> Boulay of the DR:MS. Dennis Jones of Seneca Coal Company(SCC)was present during the <br /> entire inspection. Weather conditions were sunny and cool. The mine site was heavily snow <br /> covered. Other than the use of the office area by Grassy Creek Ranch, there was no activity at <br /> the mine site. <br /> Availability of Records <br /> All required records were on file and available for review at the SCC Mine office. See the <br /> attached records checklist at the end of this inspection report. <br /> Roads <br /> Access to the site was limited to the Wadge Impoundment, the bone yard locations, the former <br /> office, and the shop/facilities area. Roads leading to these locations had been plowed but were <br /> still snow packed and icy. Road ditches and culverts were entirely snow covered. All other mine <br /> site roads were impassable due to drifted snow. <br /> Hydrologic Balance <br /> Sedimentation Ponds 002 and 003 were viewed. These ponds were completely snow covered <br /> and frozen at the surface. Pond inlets, embankments and discharge structures appeared to be <br /> stable and no problems were noted at these pond locations. <br /> Support Facilities <br /> The remaining bone yard and the shop/facilities areas were inspected. These locations were <br /> snow packed,but accessible. SCC has removed all of their materials that had been stored at the <br /> bone yard. The older bone yard has been entirely reclaimed. These locations and perimeter areas <br /> were maintained and no problems were noted during this inspection. <br />
