III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting dhe enforcement action. <br />Topsoil has recently been salvaged from a portion of the Morgan property within the Prime <br />Farmland designated area. Photograph 1 shows the topsoil horizons at this location. WFC is <br />currently drilling in preparation for blasting on Bench 1 in this vicinity. During the inspection it <br />was evident that some Bench 1 material/overburden has sloughed into the active pit. It was <br />apparent that this was Bench 1 material and not topsoil resource that has sloughed off into the pit. <br />Some Bench 1 material is placed along the edge of the bench as a safety berm. Occasionally <br />during maintenance to remove mud accumulating on the bench some material is scraped into the <br />pit. It also appears that some of the berm material has inadvertently fallen into the pit. This <br />sloughing of Bench 1 overburden material has occurred along the entire length of the active pit <br />(see Photo 2). Tlhe Bench 1 area, current drill pad location and safety berm is shown in Photo 3. <br />Photo 4 shows Prime Farmland with the topsoil stockpile constructed ahead of the active pit. <br />
