The map that <br />you enclosed with that letter is a map from Mt Sne~es Mining Co LLC, (Exhibit A) <br />dated February I5, 2008 is not the same map or maps provided to me by you that are <br />on file with your department pertaining to Permit No. M-1979-181. One of the maps <br />you provided me (Exhibit B) regarding Permit No. M-1979-181 clearly show that <br />Mt Sneffles Mining Co LLC is claiming ownership of the entire outlined azea of that <br />map, which includes the Ruby Trust No 2 Mining Claim (survey No. 2496) which <br />they don't own. Their own map submitted to your department by Mt Sneflles Mining <br />Co on February 15, 2008 (Exhibit A) clearly shows the Ruby Trust No 2 is in that <br />area. They are claiming to own in their permit application. (Which maps are right?) <br />therefore how can your department conclude there is no trespass claim. <br />There is also a prospectus (Exhibit C) of the property involved in Permit No M- <br />1979-181 that was being circulated in 2004 by Walker Ruby Mining Co.. that states and <br />illustrates on the maps in their own prospectus that they are mining and therefore <br />trespassing on the Ruby Trust No 2, Claim No 2496. <br />Therefore my position was and is that because of the multiple inaccurate maps sub- <br />mitted to your department and the admission in their own prospectus (Exhibit C) of <br />mining on the Ruby Trust vein, that the current holder of Permit No M-1979-181 (Mt <br />Sneffles Mining Co LLC) should be required to submit a certified survey of the <br />properties involved, which Y think is required by your own departments (DBMS) <br />regulations. <br />Sincerel , ,, ~ ~ f .~`' <br />Y ,,;<.~ / <br />r, ~,~, <br />Exhibits Enclosed "` <br />Donald B Nordlander <br />
