On March 4, 2008, the Division received two written complaints from Mr. Nordlander, dated
March 2, 2008. Copies of both complaints are enclosed. In his complaints, Mr. Nordlander
disputes the accuracy of the maps showing the location of the permit boundary and insists that
trespass is occurring on his land.
In response to previous complaints from Mr. Nordlander, Mount Sneffels Mining Company
(MSMC) submitted copies of a special warranty deed and a quit claim deed, which indicated a
right of entry to the patented and unpatented claims listed in the two deeds. Additionally, MSMC
submitted a portion of a map showing the surveyed location of various claims in relation to each
other. The approximate location of the permit boundary was indicated on that map by a sketched
line. The map submitted by MSMC was not signed by the registered land surveyor, professional
engineer, or other qualified person who prepared the map; did not give the date prepared; did not
show a north arrow; and did not indicate the scale of the map, as required by Rule 6.2.1(2)(b)(c)
and (e).
Therefore, within 30 days of the signature date of this correspondence, by April 3, 2008, please
submit a map in accordance with the requirements of Rule 6.2.1(2), which shows the accurate
location of the permit boundary in relationship to the surrounding claims and lands for which
MSMC has legal right of entry.
