Energy Fuels has contracted Western <br />Water & Land, Inc. to collect third party samples and Grand Junction Laboratories to <br />perform third party analysis. Energy Fuels requests your approval to suspend third party <br />sampling of the water discharge due to: <br />• the infrequency and quantity of current discharges; <br />• the sampling is duplicative of sampling required by the Colorado Department of <br />Public Health and Environment (CDPHE) Water Quality Control Division <br />(WQCD); <br />• stiff penalties for falsification of information imposed by the U.S. Environmental <br />Protection Agency (LTSEPA); <br />• qualifications of the analytical laboratory; <br />• correlation of third-party analytical data with data collected for the WQCD; and, <br />• the additional cost associated with third-party sampling and analysis. <br />As of January 28, 2008 the Whirlwind Mine has been dewatered. Since that time only <br />excess water flowing into the mine and not used in mining operations has been pumped <br />to the untreated water tank to be treated. Energy Fuels plans to let mine water build up in <br />the water treatment tank and treat water in batch runs. As a result, the water treatment <br />plant will be operated for three-day stretches, approximately once per month.
